Please read these Terms & Conditions ("Terms") carefully before using the CapsCanvas platform. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use CapsCanvas.

1. Who We Are

CapsCanvas is an AI-powered teaching resource platform operated by CapsCanvas (Pty) Ltd, a South African company. We provide Creative Arts teachers in South Africa with tools to generate CAPS-aligned lesson plans, worksheets, assessments, slide decks, and Annual Teaching Plans for Grades 7–9.

2. Your Account

You must be at least 18 years old and a qualified or student teacher to register. You are responsible for keeping your login credentials confidential. You must provide accurate information when registering and keep it up to date. One account per person — sharing accounts is not permitted.

3. Subscription Plans & Billing

CapsCanvas offers a free tier and paid Pro subscription plans billed monthly or annually. By subscribing to a paid plan you authorise us to charge your chosen payment method through our payment processor, PayFast, on a recurring basis at the start of each billing period.

  • Free plan: limited to a fixed number of AI-generated resources per month. Unused credits do not roll over.
  • Pro plan: higher or unlimited monthly generation limits as stated on the pricing page at the time of subscription.
  • Price changes: we will give you at least 30 days' notice of any price change before it takes effect on your account.
  • Cancellation: you may cancel at any time from your account settings. Your subscription remains active until the end of the current billing period; no partial refunds are issued for unused days except as stated in our Refund Policy.

4. Acceptable Use

You may use CapsCanvas resources for your own professional teaching practice. You may not:

  • Resell, sublicense, or redistribute generated content as a commercial product
  • Use the platform to generate content for another person's account
  • Attempt to reverse-engineer, scrape, or overload the platform
  • Upload or input any personally identifiable information about learners under 18 into AI prompts

5. AI-Generated Content

CapsCanvas uses large language models to generate content. While we strive for CAPS alignment and accuracy, AI-generated content may occasionally contain errors or outdated information. You remain responsible for reviewing all generated resources before use in the classroom. CapsCanvas does not guarantee that generated content meets any specific educational or regulatory standard.

6. Intellectual Property

Platform: CapsCanvas, its software, design, and underlying systems are owned by CapsCanvas (Pty) Ltd. You receive a limited, non-exclusive, non-transferable licence to use the platform for your own teaching purposes.

Generated content: Resources you generate through the platform using your own prompts and inputs are yours to use for your teaching practice, subject to the acceptable use restrictions above.

CAPS curriculum: The CAPS curriculum framework is published by the Department of Basic Education (South Africa) and remains their intellectual property.

7. Privacy & Learner Data

We collect and process your personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). We do not require you to upload learner personal information to use the platform, and we strongly advise against doing so. Do not include learner names, ID numbers, or any personal details in AI prompts.

8. Limitation of Liability

To the maximum extent permitted by South African law, CapsCanvas (Pty) Ltd will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to loss of data, errors in generated content, or service interruptions. Our total liability in any circumstances is limited to the amount you paid us in the 3 months preceding the claim.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or suspend the service for reasons beyond our control. We will give reasonable notice of planned downtime where possible.

10. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the platform. You may close your account at any time by contacting us at info@capscanvas.co.za.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "last updated" date at the top of this page and notify you by email if the changes are material. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the jurisdiction of the South African courts.
